5.1 Regarding administrative sanctions

According to Decree 144/2021/ND-CP, administrative sanctions are imposed for offending and defaming other people’s honor but not to the extent of criminal prosecution.

  • For law enforcement officers:

Pursuant to Article 21, a fine ranging from VND 4,000,000 to VND 6,000,000 shall be imposed on persons who insult, threaten or insult the dignity and honor of official duty performers with words or acts.

  • For family members:

According to the provisions of Article 54:

A fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for slandering, insulting or insulting the honor and dignity of family members.

A fine ranging from VND 10,000,000 to VND 20,000,000 shall be imposed for acts such as disclosing or distributing documents and documents belonging to family members’ private secrets in order to offend the honor and dignity; using the media to offend the honor and dignity of family members; disseminating and distributing leaflets, articles and images aimed at offending the honor and dignity of victims.

For other cases:

Pursuant to Article 7, a fine ranging from VND 2,000,000 to VND 3,000,000 shall be imposed for provoking, teasing, insulting, insulting or defaming the honor and dignity of others.

5.2 Regarding criminal handling

Acts of infringing upon the honor and dignity of others may be subject to criminal prosecution.

  • Crime of humiliating others

Pursuant to Article 155 of the Penal Code 2015 (amended in 2017), a fine of between VND 10,000,000 and 30,000,000 or non-custodial reform for up to 3 years is required for those who commit acts of seriously offending their dignity. honor others.

The maximum penalty for this crime is imprisonment from 2 to 5 years. In addition, offenders may also be banned from practicing certain occupations or doing certain jobs and from holding certain posts for 1 to 5 years.

According to the provisions of Article 156 of the Penal Code 2015 (amended in 2017), a person who fabricates or spreads things known to be untrue in order to seriously offend his dignity or honor or cause damage to his/her rights, the legitimate interests of others shall be subject to a fine of between VND 10,000,000 and 50,000,000, non-custodial reform for up to 2 years or a prison term of between 3 months and 1 year.

The maximum penalty can be up to 3 years to 7 years in prison. In addition, offenders may also be subject to a fine of between VND 10,000,000 and 50,000,000, a ban from holding certain posts, practicing certain professions or doing certain jobs for 1 to 5 years.

  • Insult other people’s honor in some special cases

According to Article 391 of the Penal Code 2015 (amended in 2017), a fine of between VND 10,000,000 and VND 100,000,000, non-custodial reform for up to 3 years or a prison term of between 6 months and 2 years, is imposed. seriously the honor and dignity of judges, jurors, other competent procedure-conducting persons or participants in court sessions or meetings. The maximum penalty for this crime is imprisonment from 1 to 3 years.

When a person commits an act of insulting the honor of another person, in addition to the above sanctioning measures, he must also compensate the victim.

Article 592 of the 2015 Civil Code stipulates that damage caused by infringing upon honor, dignity or reputation includes reasonable expenses to limit and remedy the damage; real income lost or reduced; other damages prescribed by law.

The offender must pay compensation according to the above provisions and an amount of money to compensate for the mental loss suffered by the victim. The amount of compensation will be agreed upon by both parties. If the two parties cannot reach an agreement, the maximum level for a person whose honor, dignity or reputation has been infringed shall not exceed ten times the base salary prescribed by the State.
